Adult-use Use of Marijuana in Ohio

Adult-use marijuana became legal in Ohio on December 7, 2023, following the passage of Issue 2 in November 2023. While possession and use became legal immediately, the sale of adult-use marijuana was delayed until August 6, 2024, to allow time for the state to establish regulations and licensing procedures.

Purchasing Adult-Use Marijuana

As of August 6, 2024, adults aged 21 and over can legally purchase adult-use marijuana in Ohio.
Here are the key details:

  • Customers can purchase up to Up to a 10-day supply (28.3 grams), or the equivalent in other cannabis products.
  • Available products initially include those already approved for medical use:
    • Oral forms: oils, tinctures, capsules, edibles, sublinguals, tablets
    • Topical forms: lotions, creams, ointments
    • Transdermal patches
    • Vaporization products: metered oil or solid plant material

What are the taxes on adult-use marijuana in Ohio?
Ohio intends to impose a 10% excise tax on adult-use marijuana in addition to the current 5.75% state sales tax on tangible goods.
Where does my tax money go when I buy adult-use marijuana in Ohio?
Revenue from the 10% excise tax is allocated as follows:

  • 36% to a social equity and jobs program for those disproportionately impacted by marijuana prohibition.
  • 36% to municipalities with dispensaries.
  • 25% to a substance abuse and addiction fund.
  • 3% to cover administrative costs.

Guidelines for Adult-Use Use

Ohio has established several guidelines for the legal use of adult-use marijuana:

  1. Age Restriction: Only individuals 21 and older can purchase, possess, grow, or use non-medical cannabis.
  2. Possession Limits: Adults can possess up to 2.5 ounces (70 grams) of cannabis.
  3. Public Use: Consuming marijuana in public areas is prohibited.
  4. Driving: It's illegal to operate any vehicle, including cars, boats, and aircraft, while under the influence of cannabis.
  5. Workplace: Employers retain the right to maintain drug-free workplace policies.

Additional Considerations

  1. Ohio's law prohibiting smoking or vaping in public indoor spaces applies to marijuana as well.
  2. While adult-use cannabis is now legal, it remains illegal under federal law, which can have implications for federal property, employment, and interstate travel.

As the adult-use marijuana market in Ohio is just beginning, regulations and availability may evolve. Stay informed about local laws and dispensary operations with Shangri-La!

Understanding Ohio Medical Marijuana Dispensaries & Current Regulations

Ohio made a groundbreaking move in 2016 by legalizing medical marijuana through House Bill 523. Thanks to the Ohio Medical Marijuana Control Program (OMMCP), patients with qualifying medical conditions can access and use medical marijuana with a certified physician's recommendation.

Qualifying Conditions

There are 21 qualifying conditions for medical marijuana in Ohio, including:

  • AIDS/HIV
  • Alzheimer's disease
  • Amyotrophic lateral sclerosis (ALS)
  • Cancer
  • Chronic pain
  • Crohn's disease
  • Epilepsy
  • Fibromyalgia
  • Glaucoma
  • Hepatitis C
  • Multiple sclerosis
  • Parkinson's disease
  • Post-traumatic stress disorder (PTSD)
  • Sickle cell anemia
  • Ulcerative colitis

Note: This list is regularly reviewed and updated. Patients should check with the Ohio Medical Marijuana Control Program for the most current list of qualifying conditions.

Obtaining a Medical Marijuana Card

To become a registered medical marijuana patient in Ohio:

  1. Visit a certified physician who can confirm your diagnosis of a qualifying condition.
  2. The physician will create your profile in the OMMCP Patient & Caregiver Registry.
  3. Once registered, you can purchase medical marijuana from licensed dispensaries.

Visit our Patient Card information page for more information!

What Ohio Patients Should Know

  • Annual in-person visits with a certified physician are required to maintain your status.
  • You must have a valid Ohio ID, driver's license, or U.S. passport.
  • Not all doctors can certify patients; they must complete specific training.
  • Delivery services are not currently allowed in Ohio.
  • A 5.75% sales tax applies to marijuana purchases.
  • Patients can possess up to a 90-day supply of medical marijuana.

Additional considerations

  • Product Information and Labeling: Medical marijuana products must include important information such as cannabinoid profiles, terpenoid profiles, and warnings about impairment. Additionally, any pesticides used during production must be disclosed.
  • Education for Patients and Caregivers: Dispensaries are required to provide educational materials on the proper use of medical marijuana, including safe consumption techniques, potential side effects, and guidelines on drug-to-drug interactions.
  • Returns and Recalls: Defective or mislabeled products can be returned for a refund or replacement. Patients must return recalled products within 30 days of the recall notice.

Mastering these laws and regulations is vital for Ohio medical marijuana patients to guarantee compliance and seamless access to their medicine.

Ohio Dispensary Etiquette and Safety

For our Buckeye State friends new to our dispensaries, it’s good to know a few things to ensure a smooth visit.
Here’s a friendly guide to dispensary etiquette and safety, Ohio-style.

1

Know the Local Laws

Before you head out, make sure you’re up to speed on Ohio’s cannabis laws. You’ve got to be 21 or older to buy, and there are rules about how much you can purchase. It’s always good to know the lay of the land.

2

Bring Your ID

Don’t forget to bring a valid ID with you. You’ll need to show it at the door. No ID, no entry — simple as that.

3

Be Cool and Patient

Dispensaries can get pretty busy, especially during weekends or evenings. Be patient while you wait your turn. Everyone’s there for the same reason, so let’s keep it friendly!

4

ask away

Patient consultants are there to help you out. Don’t be shy about asking questions. Whether you’re new to this or a seasoned pro looking to try something new, they’ve got the answers.

5

consume responsibly

After you’ve made your purchase, be smart about consuming it. Follow Ohio’s laws about where you can and can’t use cannabis, and never drive while under the influence. Safety first!

6

respect privacy

Not everyone wants to share their cannabis use publicly, so respect privacy and keep it discreet. Don't post pictures or videos of others using cannabis without their consent.

By following these tips, you’ll have a great time at our Ohio dispensary locations and ensure a positive experience for yourself and others!
